Terms of Service

These terms explain the relationship between NITEO and each person who accesses the website, configures a monitor, or starts a membership.

Plain-language summary

NITEO is a general market-data monitoring and research service. It does not connect to a financial account or act for a customer. Mandatory consumer rights in your country continue to apply.

Operator disclosure

NITEO is a service name of GALIO GENERAL TRADING - FZCO, registration number 82421 and commercial licence number 89182, issued through Dubai Integrated Economic Zones Authority / Dubai Silicon Oasis. Business address: IFZA Business Park, DDP, PO Box 342001, Dubai, United Arab Emirates. Public paid access remains unavailable until the payment, data-rights, jurisdiction, security, and legal launch checks are complete.

1. Who these terms cover

These Terms form an agreement between you and GALIO GENERAL TRADING - FZCO, operating the service under the name NITEO (the “Operator”, “NITEO”, “we”, or “us”). You must be at least 18 and legally able to enter this agreement.

If you use the service for an organisation, you confirm that you are authorised to bind it. Consumer-specific rights apply only where the law treats you as a consumer.

2. What NITEO provides

NITEO organises market information from multiple evidence families into configurable, aggregate monitoring views. Depending on the available plan and data rights, the service may include dashboards, Evidence Logs, scheduled summaries, material-change notices, historical context, and method or data-quality notes.

  • Coverage, sources, update frequency, and features may differ by market and jurisdiction.
  • Some pages use illustrative data and are labelled as prototypes or demos.
  • NITEO does not request credentials for a financial account, hold customer assets, arrange transactions, or act on a customer's behalf.
  • NITEO does not tailor its material to a person's holdings, finances, objectives, or risk profile.

3. Informational character

The service provides general information, software tools, and research. It is not legal, tax, accounting, or personal financial advice. A configured view reflects content and delivery preferences only; it does not make an individual suitability assessment.

You remain responsible for how you interpret information and for any independent decisions you make. Read the separate Risk Disclosure before using market information.

4. Accounts and access

You must provide accurate information, keep access credentials secure, and notify us promptly if you suspect unauthorised access. One membership is for the registered account holder unless a plan expressly allows team access.

We may suspend access where reasonably necessary to protect the service, investigate misuse, comply with law, or address an overdue payment. Where practical, we will explain the reason and provide a way to resolve the issue.

5. Availability by jurisdiction

NITEO may restrict registration, payment, content, delivery channels, or specific market coverage by location. The service is not offered where its provision would be unlawful or require an authorisation the Operator does not hold. Access from a location does not mean the service is lawfully available there.

We may use location, payment-country, sanctions-screening, or account information to apply these controls. We do not guarantee availability in every country.

6. Trial, membership, renewal, and cancellation

Where a free trial is offered, checkout will show whether a payment method is required, the trial length, the exact first-charge date and amount, and the recurring billing period before confirmation. Unless you cancel before the displayed first-charge date, the selected paid membership begins automatically using the payment method on file. A reminder will be sent before the trial ends.

After conversion, a recurring membership continues for the selected period until cancelled. A displayed Founding Beta Core rate remains protected only while that membership is continuously active and does not automatically include separately introduced premium data packs. Cancelling or allowing the subscription to expire ends the protected rate.

You can stop a trial or renewal through My Page or by contacting contact@nite-o.com. Trial cancellation takes effect no later than the end of the trial and prevents the scheduled first charge; paid-period cancellation normally takes effect at the end of that period. Mandatory cancellation, withdrawal, and refund rights may provide a different result and always prevail. The Billing & Cancellation Policy forms part of these Terms.

7. Data sources and service changes

Market data can be delayed, incomplete, corrected, unavailable, or affected by a provider change. Symbol coverage and methodology versions can change. NITEO may correct records, replace a source, modify a feature, or discontinue a data family where reasonably required.

Material changes that significantly reduce a paid service will be notified in advance where practical. If a change is required urgently for security, legal, or provider reasons, advance notice may not be possible.

8. Acceptable use

You may use the service for your own lawful internal purposes. You must not:

  • copy, scrape, republish, redistribute, or commercially resupply protected content or data except where a written plan permits it;
  • circumvent access, rate, regional, or security controls;
  • interfere with the service or introduce harmful code;
  • misrepresent NITEO material as a regulated service, personal guidance, or a guarantee;
  • remove source, copyright, methodology, or limitation notices; or
  • use the service in a way that violates applicable law or third-party data rights.

9. Intellectual property

NITEO and its licensors retain rights in the software, interface, selection and organisation of content, methodology, branding, and protected materials. Your membership gives you a limited, non-exclusive, non-transferable right to use the service during the paid period, subject to these Terms.

Third-party data and marks remain the property of their owners. Reference to a venue, instrument, or provider does not imply endorsement, partnership, or sponsorship.

10. Warranties and liability

We provide the service with reasonable care and skill. Market information is provided on an “as available” basis and cannot be guaranteed to be uninterrupted, complete, or error-free. Nothing in these Terms excludes a warranty or remedy that cannot lawfully be excluded.

To the maximum extent permitted by law, neither party is liable for indirect or consequential loss. NITEO's aggregate liability connected with a paid membership is limited to the amount paid for that membership during the 12 months before the event giving rise to the claim. This limit does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that law does not allow us to limit.

Nothing in these Terms limits mandatory consumer protections available in your country.

11. Ending the agreement

You may end the agreement by cancelling renewal and closing your account. We may end it if you materially breach these Terms and do not remedy the breach after reasonable notice, or immediately where necessary for security, illegality, sanctions compliance, or serious misuse.

Sections intended by their nature to continue—such as intellectual property, accrued payment obligations, limitations, and dispute terms—survive termination.

12. Changes and notices

We may update these Terms to reflect service, legal, security, or operational changes. We will post the effective date and provide reasonable notice of material changes to active members. A material change will not retroactively remove an accrued mandatory right.

Operational and legal notices may be delivered through the account, website, or registered email address.

13. Governing law and consumer rights

These Terms are governed by the laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai. The courts of Dubai have jurisdiction, unless mandatory consumer law gives you the right to use another court or dispute process. This clause does not deprive a consumer in the EEA, United Kingdom, or another jurisdiction of protections that cannot be waived by contract.

Please contact us first so we can try to resolve a concern. You may also use a competent consumer-protection or data-protection authority where applicable.
